FORGE PERFORMANCE – TERMS AND CONDITIONS

1. About Us

Forge Performance is a UK-based sole trader business operating from 28 London Road, Cirencester, United Kingdom. You can contact us at forge.perform@outlook.com.

2. Acceptance of Terms

By accessing this website and/or placing an order through our Shopify store, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use our website.

3. Eligibility

We recommend that customers are aged 16 or over. By placing an order, you confirm that you are legally capable of entering into a binding contract and that all information provided is accurate and complete.

4. Products

Forge Performance sells made-to-order fitness apparel using print-on-demand suppliers. Product descriptions, images and sizing guides are provided for information purposes only. Colours and sizing may vary slightly due to screen settings and manufacturing processes.

5. Orders and Contract Formation

After placing an order, you will receive an automated confirmation email. This does not constitute acceptance of your order. A binding contract is formed only when your order has been dispatched.

We reserve the right to refuse or cancel orders due to pricing errors, suspected fraud, payment issues, or other legitimate business reasons.

6. Pricing and Payment

All prices are listed in GBP (£). Payment must be made in full at checkout using Shopify’s secure payment system. We reserve the right to amend prices at any time.

7. Delivery

Estimated delivery time is 3–5 working days. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by courier services or incorrect delivery details provided by customers.

8. Cancellation and Returns

Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving the goods. As products are made-to-order, cancellation rights may not apply once production has begun. Items must be returned unworn, unused, and in original condition.

Customers are responsible for return shipping costs unless the item is faulty or misdescribed.

9. Faulty or Damaged Goods

If your item arrives faulty or damaged, you must notify us within 48 hours of delivery and provide photographic evidence. We will offer a replacement or refund in accordance with your statutory rights under the Consumer Rights Act 2015.

10. Discount Codes

From time to time, we may issue promotional discount codes. Codes must be used in accordance with their specific terms. We reserve the right to withdraw or cancel codes at any time and to refuse orders where codes are misused.

11. Intellectual Property

All branding, logos, designs, product graphics, website content, and materials are the intellectual property of Forge Performance. They may not be reproduced, distributed, or used without prior written consent.

12. Fitness Disclaimer

Our products are intended for general fitness and lifestyle use. Forge Performance does not provide medical advice. You should consult a qualified medical professional before starting any new exercise programme. We are not responsible for injuries sustained during physical activity or misuse of our products.

13. Limitation of Liability

To the fullest extent permitted by law, Forge Performance shall not be liable for any indirect, incidental, or consequential loss. Our total liability shall not exceed the total purchase price of the product giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded under English law.

14. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such delay results from events beyond our reasonable control, including but not limited to natural disasters, strikes, supply chain disruptions, or courier delays.

15. Governing Law

These Terms and Conditions are governed by the laws of England. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
